K1 vs. K3 Spousal Visa
Getting a K1 visa instead of a K3 spousal visa does have its advantages.
• Processing a K1 fiancee visa is faster compared to a K3 spousal visa
If you are in a hurry of taking your Thai fiancée to the US you might as well marry her after she enters the country and not before. If you marry her outside the country, you can no longer file a K1 visa petition and what you have to apply for is the K3 spousal visa. It may take a longer time to process a spousal visa and you may have endured more months apart waiting for its approval. This would also be a favorable choice if you cannot stay away from the country for a long time because of work or other reasons and at the same time would want to be close to your Thai loved one as much as possible. The shorter the waiting time, the more beneficial it is for you as a couple.
• The children of your Thai fiancée can be added to the K1 visa petition as K2 derivative.
This is hitting two birds with one stone. Instead of filing separate applications, once a K1 visa is granted to you Thai fiancée, her children are also granted a K2 visa to allow entry into the US. Marrying her in the US would be the easiest and least hassle way of bringing her and her children to the US.
• A K1 visa entitles her to apply for a work permit by filing a Form I-765
This would benefit you and your partner greatly as part of starting a new life together in the US. This would open up employment opportunities for your Thai fiancée which is a big help for anyone starting a new life in a foreign country.
